The Inclusion Level of Maqasid Al-Shariah Concepts (the Higher Objectives of Islamic Law) in the Fiqh 2 Textbook at the Secondary Level

Abstract

This study aimed to evaluate the extent to which the concepts of Maqāṣid al-Sharīʿah (objectives of Islamic law) are incorporated in the Fiqh textbooks (1 and 2) designated for secondary school students (Track System) in the Kingdom of Saudi Arabia. To achieve this goal, the study adopted a descriptive methodology using content analysis. A validated list of Maqāṣid concepts was developed, consisting of three main domains and eleven indicators. The content of both textbooks (Fiqh 1 and Fiqh 2) was then analyzed accordingly.
The results showed a predominant focus on the objective of protection of wealth, which accounted for 33.54% of the total occurrences across both textbooks. In contrast, other essential objectives—such as the protection of life, religion, intellect, and lineage—were either weakly represented or almost entirely absent. The foundational and theoretical domain, particularly concerning the legitimacy and importance of Maqāṣid (in relation to the Qur’an and Sunnah), was also largely missing.
The study concluded that the content in both textbooks tends to be strictly legalistic, lacking in value-based and interpretive depth, which may hinder students' understanding of the rationale behind Islamic rulings and the broader philosophy of Islamic legislation. The researcher recommends a comprehensive reform of textbook content based on an integrated Maqāṣid-oriented framework that ensures balanced representation of all objectives, connects legal rulings to their textual sources, and enriches both curriculum and teaching practices. Suggestions for curriculum development and proposals for future research were also presented.
